By using our site, you indicate that you accept these terms of use and that you agree to abide by them. If you do not agree to these terms of use, please refrain from using our site.

We do not accept any responsibility for any loss which may arise from accessing or reliance on the information on this site and to the fullest extent permitted by English law, we exclude all liability for loss or damages direct or indirect arising from use of this site.

Information about us:
The Mad Hatter of Durham is a trading name of Alexandra Robson (“We”). We are a Company registered in England. Our telephone number is: UK +44 (0191) 3700346. Our normal working day business hours are 10am-4pm GMT Monday to Friday. We are closed Saturday, Sunday and Bank Holidays. We also reserve the right to occasionally close on other days due to stock takes and holidays or other ad hoc reasons; details will be made available on the website if these occasions occur.

Accessing our site:
Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We will not be liable if for any reason our site is unavailable at any time or for any period.

Intellectual property rights:
We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your own personal reference only and you may draw the attention of others to material posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

We update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Sometimes material on our site may be out of date at any given time, and we endeavour to update this as soon as we can. If you notice anything that needs updating, please advise us – thank you.

Our liability:
The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy and we reserve the right to change any information as and when required. We have taken every care to ensure that the details on our website are accurate. Sometimes, products may have slight variations as to the photographic representation. Natural or handmade products and colour representation may vary slightly. If there are any actual errors or omissions, we will do our best to correct them as quickly as possible after being notified of them. To the extent permitted by law, we, and third parties connected to us hereby expressly exclude:

All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, or for any products or services purchased, or any websites linked to it and any materials posted on it, including, without limitation any liability for:

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

In respect of any claim, we will only be responsible for a direct loss up to a maximum of the total cost of the product provided. We must be notified within 30 days of any non-receipt of any item. If any product develops a fault whilst under warranty, and outside of our returns policy, please refer to the manufacturer.

Force Majure:
We will not be liable for any breach of agreement, for delay or failure to perform if the delay or failure is due to acts of God, civil commotion, riots, floods, drought, fire, pandemics, legislation or other causes beyond reasonable control. This does not affect your statutory rights.

Information about you and your visits to our site:
Any information we process about you is done so in accordance with the Data Protection Act 1998. Please warrant that all data provided by you is accurate. When you place your first order, we will send you a welcome email and will send you updates regarding your order. You will also receive a feedback request and monthly updates which you are able to unsubscribe from at any time. We will not pass on your details to any third party unless a third party is involved in the processing of your order. Your credit or debit card details will not be passed onto any third party and will not be stored by us.

In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you the following payment methods. Payment is to be made to Klarna.

  • Pay in [14] days: The payment period is 14 days from shipment of the goods or tickets/ availability date of the service.   • Financing: With the financing service from Klarna you can pay your purchase in flexible or fixed monthly instalments according to the conditions stated in the checkout. The instalment payment is due at the end of each month after submission of a separate monthly invoice by Klarna. Further information regarding Slice It including terms and conditions and Standard European Consumer Credit Information you can find here for the markets where this payment method is available: Austria, the United KingdomGermanySwedenNorwayDenmarkand Finland.
  • Direct bank transfer: Available in Germany, Austria, Belgium, Italy, Spain, Poland and the Netherlands. Your account will be debited directly after placement of your order.
  • Direct Debit: Your account will be debited after shipment of the goods or tickets/ availability date of the service ​or in case of a subscription in accordance with the timelines communicate​d. You will be notified about the date(s) by email.
  • Card Payments: Available in Sweden, Germany and Austria. The amount will be reserved on your card and will be debited after shipment of the goods or tickets/ availability date of the service. In case of a subscription the amount will be debited in accordance with the timelines communicated.

The payment methods Pay in [14] days, Slice It and direct debit are only available in case of a positive credit assessment. For this purpose, during the order process and handling of your purchase, we forward your data for an address and credit check to Klarna. We can only offer you the payment methods available based on the result of the credit check. General information about Klarna and the user terms per country can be found on klarna.com. Your personal data is handled in accordance with applicable data protection law and in accordance with the information in Klarnas privacy statement.

Viruses, hacking and other offences:
You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

We do not have control over the contents of those sites or resources, and can not accept responsibility for them or for any loss or damage that may arise from your use of them. Jurisdiction and applicable law:
The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site. These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

We may revise these terms of use at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you. Some of the provisions contained in these terms of use may also be superseded by provisions or notices published elsewhere on our site.

Orders:
No contract for the sale of any order will subsist until we have received full payment from you and that we have sent you a confirmation email and that the goods have been shipped to the address specified. You are responsible for ensuring all details you supply are fully accurate and we are not liable for any inaccurate information provided. If there are any changes, you must notify us immediately. If the order has already been dispatched, we can not take any responsibility for any incorrect information which you have provided.

Payment:
When you submit an order, you are confirming that all details are correct and that you will pay for the order. You must undertake that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of all the goods ordered. Please note we can not accept payment details via email as this is not secure. Payment must be made by the secure payment methods we have made available to you. We cannot accept registration or payments from anyone under the age of 18. Payment must be received in full before items are dispatched. Failure to do so would deem the transaction void. All items include any applicable sales taxes. Payment must be made in pound sterling. Some items may be out of stock in which case you will be notified as soon as this becomes apparent and you will be given the choice for a full refund for that item or you may choose to wait until it becomes available (if applicable). Current stock statuses are as up to date as we believe. However, stock inaccuracies can occur from time to time.

Shipping:

The period stated within which your order is shipped is approximate. Please allow extra time for orders to be delivered over Christmas, Bank Holidays, Holiday Periods, Sales Periods, Postal Strikes, during adverse weather conditions or other reasons beyond our control. Where possible, we will add information on to our Delivery Page. If you have not received your item within 7 days of your expected delivery date, please notify us immediately so we can investigate it for you. Royal Mail normally ask customers to allow up 21 days for delivery and couriers normally allow up to 3 days. If there are any known delays to us, we will notify you. Orders will be dispatched to the address details supplied to us by you and we can not be held responsible for any inaccuracies provided with these details. Please note that your items can be part shipped. Title to any product will pass to you once full payment has been received and the item has been shipped to you. Please note that some of our items may occasionally be fulfilled by a third-party. Delivery addresses outside of the United Kingdom may be subject to import duties and taxes which must be paid by you. Some items may be opened for inspection. For more information, please refer to your local customs office.

Cancellation:
You may cancel your items from your order at any time prior to dispatch. If your items have already been dispatched, please follow the Returns details below.

Returns:

We will accept unwanted goods returned for a refund or exchange but they must be returned in their original condition, unused (with their original packaging), with garment tags still attached within 30 days of receipt of your order. Your Order Number must be included and any other identification details. Please note we can not be held responsible for items returned without the order number and details.

In order to obtain a refund you must notify us of your intention to cancel your contract within 30 days of receipt of the goods (or prior to delivery).

The following items can only be returned if they are faulty or incorrectly supplied. Your statutory rights are not affected.

· Goods which have been made or ordered to a customer’s specification;
· For hygiene reasons, we can not accept pierced jewellery, hair accessories, cosmetics or toiletry returns

Refunds will be redeemed against the original form of tender and at that particular value.

To return items, please return your item within 30 days of receipt and follow the guidelines in our Return Policy.

Please ensure the items are packaged to prevent damage and please include a note detailing your order number, order details and whether you are returning for an exchange or refund.

We recommend you use a secure method to return your goods and retain your receipt in-case of non-delivery so you can contact your delivery provider. We regret that we can not be held responsible for non-delivery of returned goods. If you paid extra to receive your item, this cost will not be reimbursed unless goods are faulty or incorrectly supplied. Items must be returned to us within 30 days of receipt in order to receive a refund or exchange. Any items not returned to us may not be refunded or exchanged.

None of the above terms affect your statutory rights when goods are faulty or incorrectly supplied nor does it affect your rights under the Consumer Protection (Distance Selling) Regulations.
